These Terms and Conditions of Use of the website (www.bluelynxonline.com) between BLUE LYNX W.L.L, (hereinafter referred to as "Blue Lynx") and the users/registrants of the Website ("You" or "Your" or "Yourself" or "User") describe the terms on which Blue Lynx offers you access to the website and the services (as defined below) through the website.

Blue Lynx holds the right to amend this terms and conditions at any time by updating the modified terms and conditions on the website. The amended terms and conditions shall be effective immediately upon publishing on website. Your continued use of the service shall be considered as acceptance of the amended terms and conditions.

1. CUSTOMERS

You may buy goods offered online by us by completing the order steps available on our website. To buy goods via our website, you must be at least 15 years of age. By placing an order, you confirm that you are at least 15 years of age and that all information you provide is accurate, complete and not misleading.

You agree to deal with us in good faith and in compliance with all applicable laws. We may cancel orders where we consider that you have not dealt with us in good faith or have otherwise breached applicable laws, even if the order has been confirmed, at our discretion.

2. REPRESENTATION OF PRODUCTS

The website features products that have been carefully selected for sale on the website. Products are subject to availability so once a product has sold out it will be taken off the website at the earliest opportunity and may not be available again. As there is a delay between the time when your order is placed, and the time when the order is accepted, the stock position relating to particular products may change. If a product you have ordered goes out of stock before we accept your order, then Blue Lynx shall not be liable to you for being unable to provide that product. If such a situation arises, we shall notify you as soon as possible.

We will take all reasonable care to ensure that all product descriptions are correct at the time when the relevant information was first entered onto the website. We have made every effort to display as accurately as possible the features, attributes and variations of our products. However, minor errors may sometimes occur. You have every right to confirm the description of the products listed by other means.

We reserve the right to alter, without notice, the range of products, prices of products and terms and conditions of sale before you place an order. We reserve the right to withdraw any item from sale without notice.

3. PRICING POLICY

All product prices are in Qatari Riyals (QAR) and are correct at the time that the product description was first entered on to the website. Prices of products may change from time to time and any promotional discounts or offers may also be withdrawn at any time. The price of a product on the website may not be the same or correspond to the prices in any other stores for the same product and we are not obliged to match any prices.

Although we try to ensure all our product's prices displayed in the product page and anywhere else on the website are accurate, errors may sometimes occur. If we discover an error in the price of a product you have ordered, we will be unable to accept your order and shall contact you as soon as possible in order to give the option of either reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as cancelled.

4. ORDERS

You must register with our website to be able to make purchases from our online store. You must specify your name, email address, delivery address and billing address and at-least one contact number so as to process your order. We may contact you to provide additional details or to confirm your details to enable us to process any orders placed through the website. You agree to provide us with accurate and complete details when requested so. All orders are subject to acceptance by us, at our discretion.

You may cancel your order at any time before your item is dispatched by contacting us through phone, text or email. We do not provide the provision to cancel the order from your account, however, this will be added in future updates. Once the order is canceled, you will receive an email stating that the order has been cancelled and the same will be reflected on your order list.

5. OUR CONTRACT WITH YOU

After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product or products as advertised by us. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the products) has/have been dispatched (the ’Delivery Confirmation’). The contract between you and us is only formed when we send you the Delivery Confirmation.

The Contract will relate only to those products whose dispatch we have confirmed in the Delivery Confirmation. We will not be obliged to supply any other products which may have been part of your order. If we decide not to accept all or part of your order, we will not be obliged to supply any (other) products which may have been part of your order.

6. DELIVERY

We deliver within specified areas in Qatar only. Delivery charge is determined by destination and total order amount. To find out the delivery charges that apply to you, simply add the items to your shopping cart and proceed accordingly to the checkout where the full cost will be calculated and displayed before you confirm your order. It is your obligation to enter the correct delivery address details at the time of ordering.

We use all reasonable efforts to dispatch orders within 48 hours of the purchase date. It is your responsibility to inform us promptly if an order does not arrive either by emailing to shop@bluelynx.qa or submitting a support ticket from your login portal. We are not liable for any loss or damage resulting from late delivery or non-delivery and late delivery does not entitle you to cancel your order.

You will generally need to be available between 09.00am and 07:00pm to receive the delivery. You have the option to choose a different delivery address than your billing address. For example, you may want to use your work address for delivery if your employer’s workplace policies allow this. If you do not answer when the delivery person tries to deliver your order, we will leave you a note. You must then contact us to arrange re-delivery.

We may require the person accepting the delivery of your order to provide us with a proof of identity. Certain products must be signed for by an adult (aged 18 years or over) on delivery and if no one is available at the address when the delivery is attempted the products will be retained by the delivery person. He will leave notification of attempted delivery and you may re-arrange delivery at a later time.

We will not be liable for any failure to perform or delay in performance of any of our obligations under a contract with you that is caused by events outside our reasonable control. We will use our reasonable endeavours to notify you if such an event occurs.

7. PAYMENT

We process your order with our payment mode of 'Cash-on-Delivery'. You agree that the full payment for your order (including the product price and applicable delivery charges) shall be handed over to the delivery person before the items are handed over to you. If you refuses to, we will not be liable for any delay or non-delivery.

Your ordered product will be handed over once payment has been validated.

8. RETURN POLICY

You may, within 7 days of receipt of your order, return any item in unused or original condition for a full refund. In this case, you will receive a full refund of the price paid for the products in accordance with our refunds policy set out below.

If you wish to return items, you must contact our Customer Technical Support through the 'Contact us' page on our online shopping portal. You must also return the product(s) to us immediately, in the same condition in which you received them. You have a legal obligation to take reasonable care of the products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

Gift certificates and any item for which you request the inclusion of a personalized message may not be returned.

9. REFUND POLICY

If you return items within the period mentioned above and in accordance with the terms of our Returns Policy, we will process the refund due to you as soon as possible. In this case, we will refund the price of the product in full, excluding the original delivery charges charged to you. However, you will be responsible for returning the item(s) to us in its original condition.

If you return the product because you are claiming that it is defective, we will examine the returned product and will notify you of our findings and confirm whether you are entitled to a refund on the grounds that the product was defective. Defective products returned by you will be refunded in full,including the original delivery charges charged to you and other cost incurred by you in returning the item to us provided that a receipt for or evidence of such costs is provided.

Some of our products are fragile. Whilst every care will be taken to deliver the goods safely, inevitably some breakages may occur. In this event, we will replace the damaged goods.

10. RISK AND TITLE

Risk of damage, loss or deterioration to goods passes to you on delivery in accordance with these Terms.

11. PROMOTIONAL DISCOUNTS, E-VOUCHERS AND GIFT CARDS

From time to time we may offer additional discounts for purchases made via the website that do not apply in-store, or vice versa. Additionally, items offered as sets on the website may not be offered as part of a set in-store and individual prices may apply.

Any coupon, discount, offer or promotional discount offered on the website is valid only for use as part of a purchase made via the website, unless otherwise stated and subject to availability. A gift card or e-vouchers cannot be exchanged for cash or refunded.

12. GIFT MESSAGE

A free gift message facility is available on orders and is available for your own personal and strictly non-commercial use. We do not take any responsibility for the contents of messages communicated by you to a third party. Where you use this facility you agree that your message will not include any material that could be construed as defamatory, abusive, obscene, racist, offensive, harassing, threatening, vulgar or which could cause embarrassment or distress to any person. You agree not to impersonate any person, including but not limited to any of our employees or customers. The gift message facility is currently only available in English.

13. LIMITATION OF LIABILITY

We shall not be liable to pay any compensation to you, other than any refund as provided above. In particular, but without limitation, we shall not be liable to you for loss of profit, damage to goodwill, any indirect or consequential loss or damage arising out of any damage, defect, negligence or other failing on our part unless:

(i) you have expressly made us aware in writing of the nature and extent of the loss or damage which you may suffer in such situation; and (ii) we have expressly confirmed in writing that we accept liability for such matters.

Our liability for losses you suffer as a result of us breaking this agreement or any other duty owed to you (if any) is strictly limited to the purchase price of the product.
